Job Summary:

To provide advanced professional leadership, guidance, and support for a multi-functional independent legal department within the Office of Legal and Regulatory Affairs under the Office of the President. Responsible for internal complaint resolutions and investigations, including but not limited to discrimination, harassment, retaliation, and violations of UTMB’s policies and procedures in compliance with federal and state lawsand regulations and UTMB’s and UT System’s policies and procedures. Oversee compliance with Equal Employment Opportunity laws, Title IX compliance, Clery Act, and Student Conduct and Discipline, including strategic planning, education, awareness, and prevention programs.

Essential Job Functions:

  • Directs departmental planning and execution for investigations and complaint resolution processes for employment and higher education legal and regulatory complaints, including but not limited to discrimination, harassment, retaliation, and violations of UTMB’s policies and procedures in compliance with federal and state laws and regulations and UTMB’s and UT System’s policies and procedures;

  • Manages a staff of investigators and compliance officers, including deputy Title IX Coordinators and the Clery Officer;

  • Directs departmental activities and efforts with UTMB’s Department of Human Resources, Department of Legal Affairs, Office of Institutional Compliance, Student Affairs, and Police Department, where appropriate;

  • Establishes and implements a strategic plan for the department and Title IX/Clery Act compliance;

  • Develops metrics and key performance indicators for accreditation;

  • Leads integration of Title IX and Clery Act Compliance activities at all levels to ensure available resources are deployed to meet statutory requirements;

  • Maintains and updates, as required, standardized allegation intake, documentation, triage, investigation, and closure processes for investigations of employment and higher education internal legal and regulatory complaints, and violations of UTMB’s policies and procedures;

  • Responsible for overall guidance and counsel to the department to ensure all complaints are correctly recorded, triaged, investigated, and addressed;

  • Provides guidance to Correctional Managed Care and Human Resources Employee Relations, as needed, to ensure consistency and compliance with applicable laws and policies;

  • Provides executive review of investigation plans and investigation reports produced by the department to ensure consistency and compliance with applicable laws and policies as necessary;

  • Conducts high-profile or complicated investigations;

  • Maintains a thorough understanding of federal and state laws and regulations and UTMB’s and UT System’s policies and procedures and utilize this knowledge to assist investigators in identifying resources and best courses of action to take for the timely and effective resolution of investigations;

  • Monitors and tracks trends/risk and makes appropriate recommendations for corrective action or action plans;

  • Provides executive review of institutional policies and procedures in areas of responsibility;

  • Leads institution-wide training and prevention programs in areas of responsibility, including new employee orientation, new student orientation, annual compliance training, and other training programs throughout the year;

  • Ensures training is compliant with state and federal laws;

  • Serves on institutional and UT System committees;

  • Represents UTMB at UT System meetings in areas of responsibility;

  • Represents UTMB at administrative employment, faculty, or student hearings;

  • Provides advice to senior leadership as needed;

  • Ensures senior leadership is aware and kept informed of developments in open investigations and allegations as appropriate.

Marginal or Periodic Functions:

  • Other duties as assigned.

Minimum Qualifications:

  • Juris Doctorate degree

  • Five years of relevant experience conducting equal employment opportunity investigations and/or compliance investigations, in a higher education or health care setting.

Preferred Qualifications:

  • At least seven years of experience interpreting federal and state equal employment opportunity laws, affirmative action, and/or Title IX regulations;

  • Subject matter expertise in one or more areas of employment or higher education compliance;

  • Experience conducting investigations at an academic medical center; and

  • At least eight years of supervisory/managerial experience.
